V. Reporting of Discriminatory Situations
In accordance with paragraph 1 of Article 13 of Decree-Law No. 83/2018 of October 19, whenever a person with a disability is subject to less favorable treatment than that which is, has been, or may be afforded to another person in a comparable situation—amounting to discriminatory practice against persons with disabilities as provided for and punished under Article 4 of Law No. 46/2006 of August 28—that person may lodge a complaint in accordance with the provisions of Decree-Law No. 34/2007 of February 15.
The National Institute for Rehabilitation (INR, I.P.) provides a form for reporting situations of discrimination, forwarding submitted complaints to the competent authorities. Each year, the INR, I.P. prepares an annual report on the application of the law prohibiting and punishing discrimination on grounds of disability and the existence of aggravated health risk (Law No. 46/2006 of August 28).
